Section A - General Provisions

1. Introduction

    1.1 PLEASE READ THE TERMS OF SERVICE CAREFULLY. By using the Service (as defined), you agree that you have read it. and understand the terms in the Terms of Use that apply to you. These terms and the Hello Phuket Service Company Limited (hereinafter referred to as the “Company”) policies constitute a valid agreement. Legally binding (“Agreement”) between you and the Company. The Company assumes no responsibility for the actions and/or omissions of any third party service providers and for any service terms used by the third party service providers. Third party service providers are not considered agents. Employees or personnel of the company and solutions provided by third-party providers. shall not be regarded as a service provided by the Company.

    1.3 The Company may amend the terms of the Agreement at any time. and the amendments will become effective when posted on www.hellophuketservice.com or onto the application It is your responsibility to regularly review the Terms of Service. Your continued use of the Service after any changes to the Terms. Whether you review it or not You will be deemed to have consented to such amendment obligations.

2. Definition

    Words that appear in this Terms of Service has the meanings stated as follows:

    2.1 “Application” means a mobile application related to and created for download by the Company (or its licensee) to provide the Services to Users. and third-party service providers, respectively.

    2.2 “Company” means Hello Phuket Service Company Limited.

    2.3 “Company Policy” has the following meanings:

2.3.3 All other documents, policies, notices, recommendations, frequently asked questions (FAQs) or agreements provided or sent to you from time to time

    2.4 “Personal Information” means information used to verify your identity. or that can be confirmed to be you This includes but is not limited to your name, nationality, telephone number. Bank and credit card information Personal interests E-mail your photo ID card number Biometrics, race, birth date, marital status, religion, health information, vehicle and insurance information.

    2.5 “Platform” means the Company's relevant technology platform. A portal or website that, when used in connection with the application will allow users to request to use or access vehicle and delivery services

    2.6 “Personal Data Protection Policy” means the Company's personal data protection policy which can be accessed at https://www.hellophuketservice.com/member/policy which changes from time to time

    2.7 “Service” means the connection between the User and the Third Party Service Provider or other User. through the application, platform and/or software

    2.8 “Software” means any software related to the Application provided for download and installation by the Company.

    2.9 “Vehicle” means a vehicle used for transportation. As stated herein, available to users through the Service include:

2.9.1 passenger car
2.9.2 Public vehicles, i.e. hired cars that carry no more than seven passengers. Special vehicle for hire of not more than seven passengers Small four-wheel vehicle for hire
2.9.3 Service cars are business service cars. Sightseeing service vehicle and car rental services

    2.10 “Delivery” means the delivery or distribution of goods and others from the seller to the buyer.

    2.11 “Third Party Provider” means an independent third party that provides vehicles or deliveries to Users through the Services. This includes drivers and delivery partners.

    2.12 “User” means anyone who uses the Application, Platform and/or Software to search. and/or ride a vehicle

    2.13 “User Service Fee” means the service fee incurred by the User. By using the Service, including various application charges, taxes and service charges or costs that may arise from the ad hoc use of the service or vehicle.

3. Testimonials, Guarantees and Obligations

    3.1 By using the Service, you represent, authorize and undertake that

3.1.1 You are at least twenty (20) years of age or are legally permitted to enter the Agreement.
3.1.2 All information you provide. It is true and correct information.
3.1.3 You will use the Application, Platform, Services and Vehicles in accordance with the functions provided for and subject to law.
3.1.4 You will keep your account password or identification information that can be used to access the Services we provide securely and confidentially.
3.1.5 You agree to notify us immediately of any unauthorized use of your account or any breach of security.
3.1.6 You shall not interfere or in any way harm the Service, Application and/or Software.
3.1.7 You shall not commercially exploit the Application without permission. including without limitation Any modifications to the content of the Application or to copy, reproduce, publicly display, sell or use for unauthorized business and public dealings.
3.1.8 You must not allow others to use your personal information or user status. and you may not assign or transfer your account to anyone or anything.
3.1.9 You must provide proof of identity. or other documents, permits, licenses which we will reasonably request.
3.1.10 You will not use the Application to collect or transmit anything that is illegal or fraudulent.
3.1.11 You shall not use the Application and/or Software to cause annoyances. or behaving inappropriately or behave disrespectfully towards the company or third-party service providers.
3.1.12 when using the services or alternatives You have agreed to abide by the laws that apply to you and/or use. Your service and choice
3.1.13 You must not copy. or selling software or any content without the written permission of the Company.
3.1.14 You will provide the accurate, current and complete information requested for the Service and are obligated to maintain and continually update the information to keep it accurate, current and complete. at any time between the terms within the Agreement You agree that the Company relies on your accurate, current and complete information. You understand that if your information is untrue, inaccurate, out of date and incomplete in any way. 3.1.15 You will only use the access point or data account you are authorized to use.

3.1.20 You will not use any device or application adapted for the purpose of compromising, detecting or facilitating any activity intended to defraud the Company or to disrupt its use. the normal application
3.1.21 You will regularly provide the user's phone number and any other communications on your mobile phone. You confirm that you are authorized to provide such numbers to the Company in order to improve the Service.

    3.2 If you are a third party service provider, you represent, authorize and undertake the additional obligation that

3.2.1 You are in possession of a driver's license and are authorized to drive a vehicle. according to applicable law and have the appropriate license documents issued by government agencies for the purpose of providing the carriage or delivery service to a third party within the scope of the law by which you are using the service.
3.2.2 Applicable legal rights You own or have the authority to operate the vehicle. which you will use to provide services to users The vehicle is in good working condition and meets industry safety standards for that vehicle.
3.2.3 You must use appropriate equipment for road safety. (e.g. helmets) in accordance with applicable law
3.2.4 You will be responsible for all claims, judgments and liabilities arising out of accidents, loss or damage. including but not limited to Personal injury, death, property loss and property damage caused by the carriage/delivery services provided by you solely.
3.2.5 You shall comply with all local laws relating to the operation of taxi/passenger transport services. and will be solely responsible for any violations of the law
3.2.6 You shall not contact the User for any reason other than the provision of the Service and the Vehicle.
3.2.7 You will not reverse-search, track or search for information of other users or visitors of the Application. or its customers, including and without limitation, user accounts that you do not own. or source source or use the application for profit or services or information contained or provided through the application. used for disclosure purposes This includes but is not limited to personal data. which is not your personal information that has been given to use the service from the application
3.2.8 You agree to participate in random drug testing procedures organized by government agencies, agencies or designated persons.
3.2.9 You acknowledge and understand that when responding to users The burden of communication costs that may occur. will be your sole burden.
3.2.10 If you are asked to sign up for an account by someone else. The other person will be the holder of that account and you represent and authorize that you have the authority to bind others to the Agreement.

    3.3 If you are a user, you represent, authorize and undertake the additional obligation that

3.3.1 You will use the Services for your own needs, personally. and to the extent permitted For use by persons under the age of twelve (12) years (“Minors”) in such cases. You are responsible for the use of minors. You will not use the Application, Platform and/or Software to interfere. annoying inconvenience or booking a fake queue
3.3.2 You agree to provide the correct number of passengers when requested from the Service. You agree and acknowledge that if the information on the number of passengers is incomplete or untrue Third party service providers have the right to cancel your booking. And you may be charged for cancellation of the reservation. as stated in the cancellation policy
3.3.3 You will not contact any third party service providers other than those for services and vehicles.
3.3.4 You shall not inflict damage. whether intentionally or unintentionally to vehicles of third-party service providers
3.3.5 You will not create or collect any collection, collection or anything from the content displayed on the Application or Platform. whether directly or indirectly Unless it was done for personal reasons. use for non-commercial reasons
3.3.6 You shall not copy the content displayed on the Application or Platform. including product content, third party reviews to be published again on any form or medium

3.3.8 You acknowledge that when requesting a vehicle via SMS or using the Service There must be a standard communication cost.
3.3.9 You agree that the Company may, at its sole discretion, treat an account as a dormant account. If there is no use or transaction by you on your account within six (6) months from the last day of the transaction. and will suspend or restrict access to your account

4. Compatibility

    Different router models and versions Browsers and devices may have firmware that may not be compatible with the application. 5. Granting of Licenses and Prohibitions

6. Payment

    6.1. For third-party service providers

6.1.1 Expenses you have paid the Company for the Services are immediate and non-refundable expenses. (“Service Fee”), which is subject to the statutory limitations. 6.1.2 You acknowledge that the amount of User Fees paid to you by the User in conjunction with the Service Fee. for which you collect that service on behalf of the Company

6.1.4 The Company may arrange payments to you and you will receive it in the form of an electronic wallet. You acknowledge and agree that you have been properly informed by the Company regarding the procedures and methods of use of the Driver Wallet and its management.
6.1.5 You may add funds to the Driver Wallet (“Credits”) to increase the amount of Credits in the Driver Wallet. and fill the required minimum amount which will be determined by the company Credits will be replenished in the manner prescribed by the Company from time to time (such as cash and debit/credit card payments).
6.1.6 You understand and agree that the amount of credit in the driver's wallet will affect the availability of the service. and you agree and authorize the Company to automatically exchange the amount to credit. to increase the amount of credit in the driver's wallet to confirm the availability of the service
6.1.7 Credits are non-refundable and non-refundable. Credits cannot be resold. Exchange or pass on value in any case Credits must not under any circumstances be regarded, construed, or substituted for anything of value or exchange. You will not earn interest or other income on your credit. The Company may receive interest that it holds on your behalf. You agree to assign your rights to the Company for the interest earned on your credit.
6.1.8 You may check the amount of money in the driver's wallet in the application. The amount in the driver's wallet shown in the application will be proof of the driver's wallet amount.
6.1.9 You authorize the Company to debit the Driver's Wallet for any purchases made through application or platform
6.1.10 You acknowledge and understand that the Company may, at its discretion, withhold, withdraw, withdraw or otherwise credit cash or credit at its discretion. if there is reason to believe that you have done anything in connection with the scam Illegal or crime whether you will be deemed to have breached the Agreement or have been suspended from the Service for a period of time; will be considered by the company
User payment
6.1.11 The user may immediately pay in accordance with the terms of the vehicle. At the end of the service or after the vehicle confirmation This may be paid in cash or by other non-cash methods such as credit or debit cards (“Cards”). This includes the tip (if any) will be sent to you in the specified amount.
6.1.12 The Company retains the right to suspend any transaction if there is reason to believe that it may be a fraudulent transaction. unlawful or criminal, or when you and/or the user breach the terms and conditions of this Agreement; in such case You shall not assume the Company's responsibility to withhold, delay, withhold, confiscate or cancel payments to you.

    6.2 For users

6.2.1 When you have attained the use of the service or received a booking confirmation; You will be asked to pay in full or in part to a third party service provider in accordance with the Terms of Service by choosing one of the payment methods available through the Application. Any subsequent payments for that selection are automatically non-refundable.
6.2.2 You may choose to pay the Third Party Service Provider for Vehicle or Delivery charges by cash or by any means feasible. by credit card or debit card (“Card”), where
6.2.3 If you choose to pay by card, you will need to register your valid card according to the information provided in the Application.
6.2.4 You agree to verify and provide card information when registering your card with us. and when you use the service
6.2.5 The Company may suspend the transaction. or disable or limit the use of the card In the event that an error occurs in a payment which may result in a chargeback or chargeback from the financial institution or the Company having grounds to believe that the card has been used for which it may be charged deceive Illegal or related to crime or have reason to believe that you have breached the Agreement;
6.2.6 You agree to cooperate in any event related to the prevention of financial crimes. which will be requested to assist and support the Company in accordance with existing laws and requirements.
6.2.7 You are responsible for resolving any disputes relating to your Card. to the company that issued the card yourself.

7. Cancellation

    7.1 For third-party service providers

7.1.1 Users rely on you for delivery or provision of vehicles. You agree that the high and/or frequent cancellation levels or ignore the user's booking queue It will lead to a negative user experience and a negative impact on the reputation and brand of the company.
7.1.2 During which you may cancel your booking. The cancellation must be based on the reason for accepting the cancellation shown in the application. The Company holds the right to refund to you at its sole discretion. And that refund may be in the form of credit to your payment card that was used to pay before. or in any way the Company deems appropriate

8. Assessment

    8.1 Users and third-party service providers may be permitted to assess each other in relation to the provision of vehicle services.

    8.2 All assessments are automatically recorded in the company's system. And the company will analyze all the assessments received. The Company may act as it deems appropriate, including: suspend your use of the service without prior notice or reimburse you for any expenses.

9. Complaint

    9.1 Any complaints between users and third party service providers will be brought up to inform both parties directly.

10. Maintenance and cleaning costs for users

    10.1 You will be responsible for the cost of repairing the damage. or cleaning that needs to be done to vehicles of third party administrators resulting from misuse of your service or breach of the Terms of Use. The Company may hereby facilitate a reasonable charge for repairs or cleaning on behalf of a third party service provider through a payment gateway you designate or claim from you in cash. In the event that the repair and cleaning request requested by the third party service provider is confirmed by the Company

11. Intellectual property ownership

    11.1 The Company and its licensees hold ownership of the rights. Ownership and Benefits including all related intellectual property SOFTWARE AND/OR APPLICATION AND RELATED PARTS Providing services and other advice, ideas, requests for improvements, suggestions, advice or other information provided by you or any group in connection with the administration. The Terms of Use do not contain any sales agreements and do not convey to you any ownership rights in the Services or in connection with the Services. SOFTWARE AND/OR APPLICATION OR INTELLECTUAL PROPERTY RIGHTS It is owned by the Company and/or its licensors. Company name, symbol, service, software and/or application and the symbols of third party carriers and product names associated with the software and/or application. is a trademark of a company or a third party. and no right or license to use them is granted.

12. Tax

    12.1 You agree that this Agreement are subject to applicable taxes, import duties, charges, fees and/or other legal fees which may be imposed from time to time. You will be required to comply with the practices required by law to be able to assist and/or protect the Company in the claim or investigation of any tax credit, offset, deduction or refund of any tax paid; or payable in service-related activities

    12.2 If you are a third party service provider You will be responsible for paying any taxes and duties you have to pay under or in connection with this Agreement.

13. Confidentiality

    13.1 You shall maintain the confidentiality of information relating to the Company, services, products, business activities. Marketing and promotional plans or other activities in connection with the Company disclosed to you on behalf of the Company. (Whether orally or in writing whether before or after this Agreement) or that you have obtained from the Company or associated companies. both directly and indirectly or which has been made during this Agreement. You shall ensure that you use such confidential information in your use of the Service and obtain the Company's prior written consent. And must not disclose this information to third parties or use it for any other reason.

    13.2 The obligation to maintain such confidentiality It will not be used where you can show that. such information

15. Interaction with third parties

    15.1 During service You may engage in, or engage in, transactions with third parties that display or provide goods and/or services through the Platform or Application. The correspondence or agreement will only hold the correspondence between you and the third party and the Company and its authorized persons shall have no responsibility or obligation for such correspondence or agreement, neither the Company nor the associated company endorses it.     15.2 The Company may rely on third parties for advertising and marketing to provide services and mechanisms to support the Services and/or generate additional revenue.     15.3 You hereby consent and authorize the Company to collect and disclose information relating to you or your use of the Service as part of Customer Personal Data or Customer Reports or Analysis. You agree that it is your responsibility to take any action or to deal with caution with third parties with whom you interact through the Services and/or any advertising or marketing provided by third parties through the Services.

    15.4 We may use hyperlinks or other websites or other Internet content owned and operated by third parties. These Third Party Links are not under our control. We assume no liability for defects, neglects, delays, loss of reputation. Bullying, insults, guilt, indecentness, obscenity, vulgarity, imprecision or anything offensive in the content or as a consequence of accessing any link of the website, any hyperlink leading to that website or its content. This does not constitute an endorsement or confirmation of those websites or their content. It's your responsibility.

    15.5 You agree that the Application will use and modify search results from Google Maps services and data and by using the Application. You agree to abide by (1) the Additional Terms of the Google Maps / Google Earth Services https://maps.google.com/help/terms_maps.html (2) the Google Privacy Policy at https://www. .google.com/policies/privacy/ and (3) your acceptance of Google's policies at https://cloud.google.com/maps-platform/terms/aup/ and you agree that During the use of the application, you will not

(a) copy, modify, create derivative works of or reverse engineering Create a translator, translate, decompile, or otherwise perform any other task for the purpose of obtaining the Google Maps source code.
(b) sublicense, transfer, or share use of Google Maps;
(c) sell, resell or otherwise perform Google Map to third parties as part of a commercial offer; which has no separate value from Google Maps; or
(d) access or use Google Maps in any unlawful manner; or that would incur any fees to Google

16. Indemnification

    16.1 By agreeing to the Terms and Conditions by using the Service, you agree that you will protect and defend the Company. authorized person and other stakeholders such as officers, managers, members, hard workers, attorneys and representatives from all claims, fees, damages, losses, liabilities and expenses (such as attorneys' fees and administrative fees) that may arise. Up in activities related to: (a) Your use of the Service, Platform, Software and/or Applications in connection with third party service providers or users (in various cases), third party merchants, partners, advertisers and/ or sponsor or (b) you have breached the terms and conditions; prohibitions and laws, with or without being stated herein; or (c) infringement of your rights against third parties including third party service providers and users matched through the Service; or (d) your misuse of the Service, Platform, Software and/or Applications; (e) your ownership any use or operation on any vehicle, including, if applicable, providing the vehicle to the user through the Service;

    16.2 You agreeing to the service agreement during the use of the service You agree to protect and defend the Company. Applicant to exercise the rights of the company and its affiliates, officers, managers, members, employees, attorneys and representatives from and against any claim, indemnification, damage, loss, liability and expense (including, without limitation, attorneys' fees and all costs incurred by the parties). in connection with and/or in connection with actions by government agencies) arising in connection with (a) your use of the Services, Platforms, Software and/or Applications with third party service providers; three or (if any) third party merchants, contractors, partners, advertisers and/or sponsors; or (b) you breach or breach any terms or conditions of any third party. or any applicable law or regulation or (c) any infringement of any third party's rights. including third party service providers or service provider provided in the Service; or (d) you have used or misused the Service, Platform, Software and/or Applications; and (e) where applicable. openness to your owner, use or operation of the vehicle This includes finding suitable and adaptable service solutions.

17. Limitation of Warranty Liability

    17.2 The company will not show up WARRANTY ANYWHERE ARE REFERRED TO, INCLUDED, IN PART OF THE VEHICLE PROVIDED BY A THIRD PARTY PROVIDER OR VEHICLE IN USE OF THE SERVICE. You agree that you bear the risks that may arise in the use of the Services and that vehicles provided by third-party service providers will also not be recourse to the Company.

18. Network delay

    The Service, Platform, Application and/or Software may experience limitations, delays, and other problems that may arise in your use of the Internet and electronic communications, including electronic devices used by you or your third party service provider.
